Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") govern your access to and use of the Gebbora marketing website at gebbora.com (the "Site"). They form a legal agreement between you and the Operator identified in Section 2.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms cover website use only. They do not govern: (a) paid transactions for any Gebbora product, which are processed by Paddle.com Market Ltd ("Paddle") as Merchant of Record under Paddle's own Buyer Terms; or (b) your use of the Gebbora Greenhouse Simulator product, which is governed by the separate Gebbora Greenhouse Simulator End User Licence Agreement available at sim.gebbora.app/legal.

2. Operator information

The Site is operated by an individual residing in the United Arab Emirates, trading under the brand name "Gebbora" (the "Operator", "we", "us", "our"). No legal entity is currently incorporated; a registered entity may be formed in a later phase, at which point this Section will be updated.

Paddle (Paddle.com Market Ltd) is the Merchant of Record and legal seller for all paid transactions on any Gebbora product. Paddle's identity and contact details are published at paddle.com and on each Paddle checkout page.

3. Scope of these Terms

In scope

• Your access to and use of the Site — browsing, the contact form, the language switcher, and all public content.
• The relationship between you and the Operator as a visitor to the Site, and as a holder of any future Gebbora platform-level account, once such an account is offered.

Out of scope

• Paid transactions. Purchase of Gebbora Greenhouse Simulator credits, invoicing, taxes, regional pricing, payment-method disputes, and refunds are handled by Paddle under Paddle's own Checkout Buyer Terms and Refund Policy. Paddle is the legal seller of record.
• Use of the Gebbora Greenhouse Simulator product. Simulation inputs, analysis results, credit consumption, Gebbora Greenhouse Simulator account authentication, and all product-level behaviour are governed by the Gebbora Greenhouse Simulator End User Licence Agreement at sim.gebbora.app/legal.
• Other Gebbora products introduced in future. Each product will publish its own user agreement. This document covers the platform-website layer only.

4. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction if higher, to use the Site. If you are located in the European Economic Area (EEA) or the United Kingdom, you must be at least 16 years of age. We do not knowingly collect personal data from persons below these thresholds — see the Privacy Policy.

5. Platform accounts

Gebbora does not currently require a platform-level account to browse the Site or to reach the products catalogued on it. Accounts are created at product level — for example, Gebbora Greenhouse Simulator accounts are created at sim.gebbora.app and governed by the Gebbora Greenhouse Simulator End User Licence Agreement.

If a platform-level account is introduced in future, these Terms will be updated to describe registration, credentials, account security, and termination; existing users will be notified under Section 12.

6. Acceptable use

You agree not to use the Site to:

• Violate any applicable law, regulation, or right of any third party.
• Upload or transmit malicious code, interfere with the Site's infrastructure, or probe for vulnerabilities outside a responsible disclosure process.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Scrape, bulk-download, or otherwise automatically harvest content from the Site beyond what a typical browser user would retrieve.
• Engage in fraudulent activity or circumvent security, authentication, or rate-limiting mechanisms.

We reserve the right to block IP addresses, restrict access, or decline to respond to enquiries where we reasonably suspect abuse.

7. Intellectual property

The Site — including its text, images, diagrams, logos, brand marks, typography choices, and source code — is owned by the Operator or its licensors and is protected by copyright, trademark, and other applicable laws.

The Gebbora name and logo are brand marks of the Operator. You may reference Gebbora and Gebbora Greenhouse Simulator by name for editorial, journalistic, academic, and integration purposes. You may not use the Gebbora name or marks in a way that implies endorsement, partnership, or certification without prior written consent.

Third-party marks and content appearing on the Site — for example, references to Paddle, Cloudflare, Resend, PVGIS, Open-Meteo, OpenStreetMap, and open-source library names — remain the property of their respective owners and are used for identification only.

8. Third-party services

The Site relies on the following third-party services. Their availability, accuracy, and performance are outside the Operator's control:

• Cloudflare Pages — static-site hosting, CDN, and DNS. Cloudflare's terms govern network delivery.
• Resend — transactional email delivery for the contact form. Resend's terms govern email delivery; messages are sent from the gebbora.tech domain.
• Google Workspace — hosting of the Operator's staff mailboxes (privacy@, legal@, hello@, and others).
• Paddle — payment processing and Merchant-of-Record role for any paid Gebbora product. Paddle's Buyer Terms apply to purchasers. The Operator does not receive card details.
• Gebbora Greenhouse Simulator — the Operator's own greenhouse-simulation product, linked from this Site and governed by its own EULA at sim.gebbora.app/legal.

Analytics. The Site uses Cloudflare Web Analytics — a cookieless, aggregated analytics product delivered by Cloudflare as the Operator’s processor. No analytics cookies are set. See the Privacy Policy §3.3 and the Cookie Policy §4 for the full disclosure. If the analytics provider changes in future, both policies will be updated before the change takes effect.

9. Disclaimer of warranties

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied. The Operator does not warrant that the Site will be uninterrupted, error-free, or free of security vulnerabilities.

Content on the Site — including descriptions of Gebbora Greenhouse Simulator's capabilities, pricing examples, marketing copy, and feature roadmaps — is informational only. Definitive terms for any Gebbora product live in that product's own user agreement and pricing page. Roadmaps are indicative and may change without notice.

Third-party data and services referenced on the Site (PVGIS, Open-Meteo, OpenStreetMap, Paddle, Cloudflare, Resend, Google) are subject to their own terms and uptime commitments, none of which are controlled by the Operator.

Note: some jurisdictions do not permit the full exclusion of implied warranties. In those jurisdictions, the exclusions above apply only to the extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by applicable law, the Operator's total aggregate liability to you for any claim arising out of or related to these Terms or your use of the Site shall not exceed USD 100 (one hundred US dollars).

In no event shall the Operator be liable for indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or business opportunities; or losses arising from reliance on content published on the Site for investment, construction, operational, or professional-advisory decisions — even if advised of the possibility of such damages.

For paid transactions, Paddle's separate Buyer Terms and Refund Policy govern refunds and related disputes. Disputes over product functionality (for example, Gebbora Greenhouse Simulator simulation outputs) are governed by the Gebbora Greenhouse Simulator EULA.

Note: mandatory consumer-protection laws (for example, within the EEA or the United Kingdom) may grant you rights that these Terms cannot limit. Where that is the case, those rights apply in addition to the limitations above.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless the Operator from any third-party claim arising out of: (a) your violation of these Terms; (b) your violation of any applicable law; or (c) your violation of any right of a third party in connection with your use of the Site.

12. Changes to these Terms

The Operator may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent change. Material changes — for example, the introduction of platform-level accounts or a shift in governing-law jurisdiction — will be announced on the Site's homepage for at least 14 days before taking effect. Continued use of the Site after the effective date constitutes acceptance of the updated Terms.

13. Governing law and dispute resolution

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation.

If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

For users located in the EEA or the United Kingdom, mandatory consumer-protection laws of your country of residence apply in addition to this clause.
